THE ECONOMIC AND GUIDING CONSTITUTION IN LIGHT OF THE JUDICIALIZATION OF HEALTH https://revbaianaenferm.ufba.br/index.php/rigs/article/view/69525 <p>This paper develops a critical analysis of how the Judiciary addresses health-related issues as a means of ensuring this right for all individuals. It takes as its starting point the text of the 1988 Federal Constitution, which classifies health as a fundamental social right and a duty of the State, to be guaranteed through full and equitable access to health measures and services, regardless of each individual’s social condition. However, it is observed that, under the influence of neoliberal conceptions, the right to health has, in practice, been neglected, leading to a significant increase in lawsuits seeking access to basic resources or treatments. As a result, judicial interventions in matters that, under normal institutional functioning, should be addressed by the Executive and Legislative branches—primarily responsible for ensuring these rights—have become increasingly frequent. In this context, the judicialization of health emerges as a relevant criterion for assessing the effectiveness of the protection of this right, raising the question of whether judicial means alone are sufficient to guarantee the provisions set forth in the constitutional text. This discussion is essential to reflect on the direction of public health policies in contemporary Brazil, considering the limits and possibilities imposed by the democratic regime. The methodology adopted is bibliographic and documentary in nature, with a descriptive purpose, employing a qualitative approach and a pure research design. It was also found that there is a need to adapt administrative and judicial measures and parameters that would enable the State to implement actions capable of optimizing the use of public resources and enhancing the effectiveness of the right to health. </p> WOLNEY NASCIMENTO DE Copyright (c) 2026 Revista Interdisciplinar de Gestão Social https://creativecommons.org/licenses/by-nc/4.0 2026-04-04 2026-04-04 13 3 Alternative Spaces for Work Organization https://revbaianaenferm.ufba.br/index.php/rigs/article/view/47221 <p>This article aimed to understand how the relationship between rationality and work organization takes place in the context of street art. This is a narrative research, with a qualitative strategy, inductive orientation and exploratory descriptive purpose, where the way of organizing the work was investigated, in light of the rationalities of the artists: Ademir Antunes; Eduardo Marinho; Markos Paullo and Leonir Carvalho de Lima, who approach the characteristics of unconventional forms of work. Theoretical basis was sought in critical studies of administration, which question the predominance of the dominant organizational model, as an ideal type, especially in Guerreiro Ramos' theory and the like, about rationality. It also presents recent studies dedicated to work in the street. It is time to move quickly to the biodynamic cooperative model of agriculture.</p> <p>Cooperatives improve the loan exchange of inputs and machinery, help improve education, reduce family poverty and information redundancy due to the creation of a mutual knowledge base and a high level of trust between members.</p> <p>Providing a new perspective to the existing literature, this paper presents a Culture - Knowledge - Intelligence - CKI model that explains the impact of culture on knowledge and intelligence. The photographic records were configured as a photodiary of the research team's dialogues with the occupation – documenting the application of questionnaires and interviews with residents and their families.
