Abstract

This article explores the relationship between Jusphilosophy and animal rights in Brazil, analyzing how philosophical approaches to Environmental Law contribute to animal protection and discussing the challenges faced in this field. The text addresses the theories and philosophical currents, both in the historical and contemporary context, that support the protection of animals, the evolution of animal rights in the Brazilian legal scenario, through legislation and judicial decisions, and the ethical and practical tensions that involve the recognition of animals as subjects of law. The objective of this research is to examine the relationship between the concept of Jusphilosophy and animal rights, from the first philosophical ideas in Ancient Greece to modern conceptions. Furthermore, we seek to discuss the relevance of this concept in Environmental Law, understanding how it can strengthen the legal and ethical understanding necessary for the protection of animals in Brazil. To carry out this study, a qualitative approach of a bibliographic nature was adopted, with research in periodicals, articles, monographs, books and legislation on the topic. The final considerations present a summary of the main points discussed throughout the work, as well as suggestions and analyzes on the topic.

Valdenio Mendes de Souza, Escola Superior Dom Helder Câmara

Master's student in Environmental Law and Sustainable Development at Dom Helder Câmara Higher School (ESDHC). Specialist in School Management, School Supervision, Literacy and Literacy from the Higher Institute of Education of Janaúba - ISEJAN (2011), in Religious Sciences with an emphasis on Religious Education from the Institute of Social and Human Sciences - ICSH (2015), in Municipal Management from the Federal University of Jequitinhonha and Mucuri Valleys - UFVJM (2018), in Digital Education from the State University of Bahia - UEBA (2023) and Theater and Education from the Federal Institute of Education, Science and Technology of Northern Minas Gerais - IFNMG (2024). Graduated in Letters - Portuguese and English from Faculdade Cidade de João Pinheiro - FCJP (2010) and in Physical Education from the State University of Montes Claros - UNIMONTES (2014). Member of the ESDHC Research Group: Human Rights as a Political Project of Society. I have been working in education since 2008, with experience as a Basic Education Teacher, Pedagogical Supervisor and School Principal. Currently, I am a civil servant at the State Secretariat of Education of Minas Gerais (SEE/MG), performing the functions of Basic Education Teacher and Pedagogical Supervisor at the Antônio Thomaz Ferreira de Rezende State School, in Uberlândia/MG.

José Adércio Leite Sampaio, Escola Superior Dom Helder Câmara

PhD in Law from the Federal University of Minas Gerais (2001) and post-doctorate from the University of Castilla la Mancha (2018), master's degree in Law from the Federal University of Minas Gerais (1997) and undergraduate degree in Law from the Federal University of Minas Gerais (1992). He is currently an adjunct professor III at the Pontifical Catholic University of Minas Gerais, professor of the Master's and Doctorate courses in Law at the Dom Helder Câmara Higher School, in the area of ​​concentration "Environmental Law and Sustainable Development", full professor at the Dom Helder Câmara Higher School and Attorney General of the Federal Public Ministry. He has experience in the area of ​​Law, with an emphasis on Law, acting mainly on the following topics: Fundamental Rights, Environmental Law, Right to an Ecologically Balanced Environment, Constitutional Law and Ecological Disaster. Author of several books and articles on Human Rights, Democracy, Constitution and Environment. Member of the editorial boards of several academic journals.
