Abstract

This wording aims to examine the Bill No. 2.859/2021 of the Chamber of Deputies, which aims to include in the Refuge Statute of 1997 the debate on sex, sexual orientation and gender identity as hypotheses that would allow the request for recognition of the refugee status. In this way, we will appropriate the guidelines of the Constitution of the Republic of 1988 (CR/88), international documents and the opinions of specialists so that we can provide our perspective on LGBTQIA+ refugees and whether this eventual inclusion would be adequate in the light of Human Rights, and if appropriate, we will suggest refinements in this Bill No. 2.859/2021 of the Chamber of Deputies.

Bachelor's degree in Law from FND/UFRJ. Legal Process Analyst at DPERJ. Lawyer. Former substitute professor of Civil Law and Private International Law at FND/UFRJ (2024-2023 and 2015-2014). Member of the Brazilian Bar Association (IAB). Member of the Laboratory for the Study of Transformations in Brazilian Urban Law (LEDUB). Author of the books: Non-National Immigrant Workers: For a (Re)framing in Light of Human Rights (2022) and The Reference and Assistance Center for Immigrants (CRAI-Rio) in a case study: temporary housing for refugee groups in the city of Rio de Janeiro (2025).
