INTERSPECIES JUSTICE IN THE COSMOS: THE NEED FOR LEGAL PROTECTION OF NON-HUMAN ANIMALS IN SPACE EXPLORATION

This article examines the use of animals in space missions in light of International Space Law and contemporary ethical reflections. Since the early experiments of the space race, animals have been subjected to tests in extraterrestrial environments without adequate legal support, revealing a regulatory gap and an anthropocentric bias within existing legal structures. This bibliographic research shows that the main international treaties, such as the 1967 Outer Space Treaty, do not include provisions for the protection of these sentient beings. Given the advancement of aerospace technologies, the prospect of colonizing the Moon and Mars, and the growing prominence of private companies in the sector, there is an urgent need to reconsider the current legal framework for outer space. The article advocates for the creation of an interspecies legal regime, grounded in principles such as precaution, intergenerational responsibility, and the recognition of animal sentience. It concludes that scientific and technological progress must be aligned with ecological and interspecies justice, ushering in a new era of ethical responsibility in the exploration of the cosmos.
