Título em Inventor Artificial Intelligence? Legal Analysis of the "Dabus" Case by the Attorney General's Office

Generative Artificial Intelligence (AI) is the result of the computational model of neural networks, big data, and the internet. This article deals with inventions arising from Artificial Intelligence and the possibility of it being considered an inventor at the National Institute of Industrial Property (INPI). The object of study was the opinion of the Attorney General's Office on the Dabus case. The objective of the article was to analyze the aforementioned opinion so that it can be studied as an instrument that fills the activity of the BPTO in the authorization of insertion of generative AI as a product creator. Works selected in bibliographic and documentary research were analyzed in order to apply the hermeneutic method of comprehension in a qualitative approach. As a result, it was concluded that the AGU did not accept the possibility that generative AI is the owner-creator in the case of an invention patent, but the agency recognizes the possibility of future legal modifications.
