Crimes against Geographical Indications: critical analysis of the legal aspects of criminal protection of Geographical Indications in Brazil

Abstract

Recognizing its status as a relevant legal asset, the Brazilian legal system invokes criminal law to serve as an instrument for protecting Geographical Indications. But, considering the current terms of Law n. 9.279/1996, the following question arises: is the Brazilian legislation, from a criminal perspective, effective for the protection of Geographical Indications? In this sense, the general objective of this study is to promote a critical analysis of the Brazilian legislation, from a criminal perspective. For this, a qualitative, exploratory approach was adopted, through a bibliographical review. It was found that, regarding criminal protection, the geographical indication still enjoys little prestige with the national legislator, having the lowest penalties among the other institutes of intellectual property. It was concluded that, if any effectiveness is expected regarding the criminal protection of geographical indications, in Brazil, we need an urgent reform in the Industrial Property Law.

Author Biographies

Alessandro Vitor de Souza, University of Brasília

Master's student in Intellectual Property and Technology Transfer for Innovation, at the Focal Point of the University of Brasília-UnB (PPG/PROFNIT/UnB - Class 2022). Graduated in Law from the University Center of Sete Lagoas - UNIFEMM (2006). Postgraduate degree in Civil Law and Civil Procedure from the Catholic University of Rondônia. He served as Professor of Introduction to the Study of Law, Civil Law, Criminal Law and Administrative Law at Faculdade Pitágoras / Metropolitana de Marabá (2018 to 2020). He is a member of the Armed Forces, where he has already served as Legal Adviser at the Hospital de Garrnição de João Pessoa (2012 to 2017) and at the Hospital de Garrnição Marabá (2017 to 2020). He currently works in the Legal Support Section of the Army Command Office in Brasília.

Alessandro Alessandro, University of Brasília

Bachelor in Business Administration, Master in Geography from the University of Brasília-UnB, Doctor in Political Science from the Statale University of Milano, Doctor in Business Administration from the Cormerciale Luigi Bocconi University in Milan, both in Italy, Specialist in Business Strategy from the Getúlio Vargas Foundation – FGV. Between 1980 and 2005, he was Manager of Commercial Network Development and Planning and Control at Royal Dutch Shell / Italy. He was a researcher at the Institute for Applied Economic Research – IPEA. Since 2005 he has taught at the State University of Goiás – UEG, in the Public Administration course at Faculdade Processus and other private universities, he teaches at UNB since 2005, in the Administration department, in the Geography department and is currently a Visiting Professor at the Centro Support for Technological Development – CDT/UnB, where he also works in Post-Graduation in the Professional Master's Degree in Intellectual Property and Technology Transfer for Innovation – PRONIT/UnB.

Érika Aparecida de Moura e Souza, University of Brasília

Master's student in Intellectual Property and Technology Transfer for Innovation, at the Focal Point of the University of Brasília-UnB (PPG/PROFNIT/UnB - Class 2023). Graduated in Law, with specialization in Environmental Law and Legal Aspects of Intellectual Property. Worked as a Professor of Civil Law and Theory of Legal Argumentation for the Law course classes at Faculdade Pitágoras/Marabá and Metropolitana, both in the city of Marabá-PA, in 2019 and 2020. Rondônia, as a statutory public servant. She also worked with the Public Defender of the State of Paraíba, as a Legal Advisor.

Flávia Diniz Mayrink, University of Brasília

Master's student in Intellectual Property and Technology Transfer for Innovation, at the Focal Point of the University of Brasília-UnB (PPG/PROFNIT/UnB - Class 2023). She holds a degree in International Relations from the Catholic University of Brasília (2001), an MBA in Project Management from the Getúlio Vargas Foundation (2003) and a Masters in European Studies and Global Affairs from the Universitá Cattolica del Sacro Cuore di Milano (2006). He is currently a Science and Technology Analyst at the Ministry of Science, Technology and Innovation, assigned, since 12/2014, to the Budget and Finance Coordination of the National Institute of Social Security for the perception of Temporary Bonus of the Units of the Structuring Systems of the Federal Public Administration - GSISTE.
