Abstract

This article addresses the “discovery of the crime victim” movement, promoted by Victimology and restorative justice. It deals with the problem regarding the legitimacy of the victim or his legal representative to supervise and actively participate in the criminal investigation. It aims to clarify how the victim's defender can intervene in the police investigation. It concludes that the participation of the victim or tear legal representative in the criminal investigation can be a factor in improving its quality and that this intervention must be regulated by law. Master's and PhD in Law from the Federal University of Bahia. Adjunct Professor of the undergraduate and graduate programs (master's and doctorate) at the Federal University of Bahia and professor at the Bahian School of Law. Partner at the law firm Sebástian Mello, Marambaia e Lins Advogados Associados s/c. He has completed a specialization course in Criminal Sciences and German Criminal Dogmatics from Georg-August University of Göttingen, GAUG, Germany.

Nelson Gaspar Alvares Pires Neto, Federal University of Bahia

Master of Laws candidate at the Federal University of Bahia, Specialist in Digital Compliance from Mackenzie Presbyterian University (2020-2022), Specialist in Criminal Sciences from the Baiana Faculty of Law (2014), Specialist in Public Security Management from the National Police Academy (2009), and Bachelor of Laws from the Catholic University of Salvador (1997). He is a Special Class Federal Police Delegate, Internal Instructor of the Executive Branch of the State of Bahia and the Bahia Civil Police Academy, and currently serves as Chief of Staff of the Secretariat of Public Security of Bahia. He previously served as Inspector General of the Secretariat of Public Security of the State of Bahia. He has experience in the field of Law, with an emphasis on Administrative Law and Criminal Law.
