Abstract

This article analyzes the challenges posed by algorithmic governance to the legal order, with emphasis on the limitations faced by countries on the global south. Its objective is to examine the proposal of Legal Protection by Design (LPbD) – the incorporation of legal protections into the architecture of the code – in light of the paradigmatic transition from legal normativity to the regime of algorithmic micro-instruction. The methodology consists of a qualitative bibliographic review, articulating legal theory, legal sociology, and political economy. The discussion demonstrates that while LPbD emerges as a theoretical response to algorithmic opacity and decisionism, its effectiveness is conditioned by profound asymmetries in technological, economic, and regulatory power inherent to technonationalism and platform capitalism. It concludes that, on the periphery of the system, the promise of legal protection from the design stage is hindered by structural dependency and may become another mechanism of technological domination, rather than an instrument of emancipation and guarantee of fundamental rights.
