DISRUPTING THE PRISON

THE REALITY OF LGBTQIAPN+ PEOPLE IN THE CONTEXT OF THE BRAZILIAN AND SERGIPAN PRISON SYSTEM

Abstract

The prison system, in its structure and functioning, has been called upon to reflect on the inequalities and exclusions present in society, which substantially affect qualitatively marginalized groups. In this context, the LGBTQIAPN+ population faces specific challenges that exacerbate vulnerability and suffering both inside and outside prison walls. This proposal aims to reflect on the reality of LGBTQIAPN+ individuals within the Brazilian prison system, with a particular focus on its dynamics in the state of Sergipe. To this end, we adopt a qualitative research approach, based on bibliographic and documentary analysis, from a critical gender studies perspective. The discussion brings forth historical, legislative, and cultural aspects, highlighting the urgent need to revise social public policies for this population, as well as to promote a profound cultural shift in both society and the prison system. Furthermore, it emphasizes the multifaceted discriminations, violence, and human rights violations experienced by this population while deprived of liberty, reflecting their historical and institutional marginalization. Whether in the allocation of prison units according to gender identity, the implementation of institutional training programs on sexual and gender diversity, or the development of social reintegration initiatives, it is crucial to stress that the incorporation of public policies for LGBTQIAPN+ people within the prison system is directly linked to the protection and defense of their social rights, the restoration of self-esteem and social interaction, and ultimately, the process of resocialization.
