This study examines the global guidelines and Peruvian legislation related to the rights of persons with disabilities and their access to justice, specifically within the context of women who have experienced gender-based violence (GBV). The aim is to identify the challenges they face within the judicial system. A qualitative approach based on a case study was employed. International and national normative documents from Peru were analyzed. Four semi-structured interviews were conducted with women victims of GBV in Metropolitan Lima, one of whom has a disability (aged between 30 and 50 years), selected through convenience sampling. The analysis was thematic. The analysis of the international and national legal framework demonstrates a legal obligation to uphold equality of rights and non-discrimination for women with disabilities who are victims of GBV. However, the interviews revealed obstacles in obtaining justice, including: 1) limitations in physical accessibility of judicial spaces; 2) poor communication and limited information regarding judicial processes; 3) lack of awareness about mechanisms to file complaints; and 4) deficiencies in institutional support, such as lack of accompaniment, revictimization, and absence of follow-up. There exists a discrepancy between legislation and the lived experiences of women victims of GBV. It is necessary to implement a comprehensive reform of the Peruvian judicial system to ensure effective access to justice, including infrastructural adaptations, accessible communication strategies, judicial training, and specialized care protocols.
