REPRODUCTIVE DAMAGE AND CIVIL LIABILITY: A SYSTEMATIC STUDY OF SPECIALIZED LITERATURE AND THE LIMITS OF ITS RECEPTION BY THE BRAZILIAN LEGAL SYSTEM.

This study aims to analyze existing academic literature on civil liability in lawsuits involving so-called wrongful birth, wrongful life, and wrongful conception. To this end, a systematic literature review was conducted using sources such as the Capes Portal, SciELO, Google Scholar, and the Brazilian Digital Library of Theses and Dissertations, including scientific articles, dissertations, theses, book chapters, monographs, and other publications in the field of Applied Social Sciences and Law. After selection and refinement, 27 texts were examined, offering different perspectives on legal liability resulting from reproductive harm. To organize the theoretical understanding of the phenomenon, the findings were structured into thematic axes: the foundations of civil liability in these cases, the bioethical conflicts involved, the CFM's position on assisted human reproduction techniques, and the challenges of reparation in the face of reproductive autonomy. The literature review indicates that approaches to wrongful behavior often engage with categories such as human dignity, foreseeability of harm, and the ethical limits of medical and legal practice, revealing a field that is still expanding and rife with interpretative controversies.
