Abstract

The Brazilian legal system is made up of several constitutional and infra-constitutional rules, especially regarding the protection of human beings. The objective of this research is to analyze the need to implement public policies so that fundamental rights and personality rights are guaranteed. Using the deductive method and historical, bibliographical and documentary methodology, it analyzes various scientific works and articles, and internal legislation on fundamental rights, especially access to justice, and personality rights. The conclusion is that, although many fundamental and personality rights are legitimized in the country's legal system, their simple legal provision is not enough, which is why public authorities are required to implement public policies that allow them to be fully guaranteed to each and every citizen.
