Imperfect Agency and State Tutelage: The Implicit Sexual Contract in the Case of Female Gas Station Attendants in Pernambuco

This article investigates gender violence in labor relations based on the analysis of the decision by the Labor Court of Pernambuco (2025), which prohibited the requirement of sexualized uniforms (crop tops and leggings) for gas station attendants. The study utilizes this case as a strategic event to demonstrate how the public/private dichotomy conceals the sexual appropriation of female bodies by the market. By articulating Carole Pateman’s critique of the social contract, Catharine MacKinnon’s theory of sexuality, and Heleieth Saffioti’s domination-exploitation unity, it is argued that free business initiative attempted to validate an implicit sexual contract of servitude. The analysis problematizes the role of the State and contrasts the risk of moral tutelage and the "production of the victim" with the need to guarantee material conditions for autonomy. It concludes, through Flávia Biroli’s concept of "differentially imperfect agency," that judicial intervention was necessary not to place women under guardianship, but to correct structural asymmetries that manufacture consent in contexts of precarity.
