A PERVERSIDADE DA INDIGNAÇÃO SELETIVA

Abstract

This editorial examines the phenomenon of selective indignation within the context of sexual minorities, understood as the tendency of certain groups and individuals to oppose only those forms of discrimination that directly affect them, while attributing lesser relevance to violations perpetrated against other vulnerable groups. The article analyzes how this selectivity manifests both in the internal hierarchy within the LGBTQIAPN+ community (to the particular detriment of transgender and intersex persons) and in the undervaluation of feminist agendas, as illustrated by examples drawn from football culture, social media, and widely consumed popular music. Drawing on the precedents established by the Brazilian Supreme Court in HC 82.424-2 and ADO 26, the editorial argues that misogyny shares the same structural roots as homotransphobia and social racism, and therefore demands an equivalent response from the legal order. It concludes that selective indignation constitutes, in itself, a form of discrimination, one of particular pervasiveness insofar as it generates a false sense of engagement against social inequities, and is therefore incompatible with the foundational principles of a Democratic Rule of Law, in which fundamental rights are not subject to scarcity.
